Research on Legal Issues Concerning Employers' Unilateral Termination of Labor Contracts

This thesis focuses on the legal issues related to employers' unilateral termination of labor contracts. Through in-depth analysis of relevant provisions in the Labor Contract Law and combining with a large number of real and typical judicial practice cases, it systematically sorts out the dilemmas and contradictions existing in the operation of the current system. The study finds that prominent problems include vague definition of "serious violation", disputes over the application of moral principles, and abuse of the "last-place elimination system". In response to these issues, this paper puts forward improvement suggestions from the aspects of clarifying legal concepts, strengthening judicial review, and standardizing enterprise management, aiming to balance employers' autonomy in management and workers' legitimate rights and interests, and promote the healthy and orderly development of the labor market.
